Shocking News: Violating People is Demoralizing

November 21st, 2010

As anyone who thinks about it would realize, the sexualization of the TSA has resulted in some serious morale problems at the TSA, sparking comments like this:

“Molester, pervert, disgusting, an embarrassment, creep. These are all words I have heard today at work describing me, said in my presence as I patted passengers down. These comments are painful and demoralizing, one day is bad enough, but I have to come back tomorrow, the next day and the day after that to keep hearing these comments. If something doesn’t change in the next two weeks I don’t know how much longer I can withstand this taunting. I go home and I cry. I am serving my country, I should not have to go home and cry after a day of honorably serving my country.”

My only disagreement is… you aren’t honorably serving your country.

Simply taking orders isn’t honorable.  That defense went out a long, long time ago.  Everyone who really serves takes an oath similar to this:

I, (name), do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.

You, at the TSA, are not supporting or defending the Constitution.  You are violating it.  You know that you are violating it.   That is the quiver that crawls up your back every time you put your hands on someone who is obviously not a danger to any American.  At this point, the only way you can serve honorably at this point is to quit, or stop performing the invasive searches.  Who is going to know if you stop grabbing people’s genitals?  Who is going to complain?

As long as this goes on, you are an enemy to the Constitution, a domestic enemy.

TSA Threatens to Commit Judicial Suicide

November 16th, 2010

TSA decides to go full mafioso on the guy who, uh, did what they told him to do.

First of all, if they really had the authority to do this, they never would have worried about it.  Here’s a thought experiment.  Suppose a police officer (you know, a real law enforcement officer) decides to, with legal authority, give you a pat down.  A real patdown involves more than just brushing the genitals.  It involves a full on groping, by necessity.

Tell that cop, “if you touch my junk, I’ll have you arrested for sexual assault.”  What is that cop going to do?  He’s going to say, “tell it to the judge” and then he’s going to do his pat down anyways.  Why?  Because he actually has authority.  The TSA balked.  You know why?  They know they don’t have the authority to do this.

In any event, there is no way that the TSA will actually sue him.  So far, their statute (the ATSA) is still on the books is because the courts won’t give anyone standing to challenge it.  It’s the same story as the Obama/Birth Certificate stuff.  It’s never been ruled on in court because no one has standing.  If the TSA names him as a defendant, they are admitting that he has standing, and he can challenge it all the way to SCOTUS if they will grant cert.

Even if they don’t, they will have to bring the suit in Federal court, under the Federal Rules of Civil Procedure.  The FRCP are fairly unforgiving to government agents when it comes to discovery, and the TSA has no desire to expose themselves to that sort of sunlight.

In short, they are holding a press conference because to file a lawsuit would be political and judicial suicide.

By the way, in a quick perusal of the act, I don’t see a severability clause.  So it may be that if any part of the act is struck down, the TSA ceases to exist as an entity.  Fun!

Opt Out

November 11th, 2010

There’s a National Opt Out Day being planned.  I don’t need it.  I already opt out, every time, and will continue to opt out, every time.  Two times and counting.

I don’t need the radiation.  We still don’t know what the long term effects are, and if you believe that the emitted amounts published by the manufacturer are even accurate when they leave the factory, much less after they’ve been in the hands of the TSA for a while and under their maintenance, you are a fool.  Add in that we know that the TSA has been lying about not storing the images, and that this technology would not have even caught the guy who prompted it’s installation (the underwear bomber), then it gets even more silly and dangerous.

So opt out.  For your health, for your privacy, and for your safety.

Prescience

November 8th, 2010

As many as 14 armed Orange County deputies, including narcotics agents, stormed Strictly Skillz barbershop during business hours on a Saturday in August, handcuffing barbers in front of customers during a busy back-to-school weekend.

It was just one of a series of unprecedented raid-style inspections the Orange County Sheriff’s Office recently conducted with a state regulating agency, targeting several predominantly black- and Hispanic-owned barbershops in the Pine Hills area.

It’s funny how I knew the bold part before I even got there.

It’s simple.  These are BS, warrantless, causeless drug raids.  And they don’t pull that crap in white neighborhoods.  Some white narc somewhere heard Paul Mooney joke about people selling drugs out of barbershops on Chapelle’s Show, and decided that this would be brilliant.

Instead, it’s just disgusting.  You want to unemploy the last few racists with good jobs in this country?  Fire all the cops.

Petty Personified

November 8th, 2010

So, two months ago, Craig Watkins threw a tantrum about having to eliminate two attorneys from his staff to help balance the county budget.

This is how he responded:

Two prosecutors in the Dallas County District Attorney’s office were dismissed Friday after they attended a Republican election watching party.

Tom Nowak, a child abuse prosecutor, was fired. I’m told that John Grau, who has been with the DA’s office 25 years, was asked to leave and retired. Grau was the chief prosecutor in one of the felony courts.

Mr. Watkins, you are not persuading me that I was mistaken in voting against you.

Dallas Wet-Dry Vote

November 4th, 2010

I put this together to help me sort it out in my own mind.

Bright green is a dry area that voted to become wet.  Bright red is a dry area that voted to stay dry.  Light green and red are wet areas, same theme.  The yellows were ties (all in dry areas.)

People made this out to be a north-south thing, but there is another aspect to it.  Even in the south, dry areas that were near a wet-dry border still tended to vote wet, and wet ares, and in the north, only dry areas voted to keep the division.  They are the ones who see the money going across the border (like mine north of I-635.)  As much as I would like to make this one out to be about freedom, I think that economics led the charge here.

Dear Republicans

November 3rd, 2010

Don’t get the big head.  Here’s the deal.

We took a bite from your end of the shit sandwich this time because it looked to be a lot less runny than the other end, and you kept saying that there’s so much more bread and not so much turd on your end.  Not like last time, where the first bite was okay, and then it was all turd soup and soggy bun.

What am I trying to say?  I’m saying that if this end goes squish too, then we’re gonna stop eating at this deli.  Maybe find a nice Tea Room somewhere.
